Terms and Conditions of Sale
These terms and conditions of sale (T&Cs) govern sales concluded on the website alyvoa.com between the seller and any consumer customer. Any order implies full and unreserved acceptance of these T&Cs.
1. Seller
Roberto Bilic, sole trader operating under the brand Alyvoa — Rue Frans Hals 104, 1070 Anderlecht, Belgium. Company number (BCE): 1036.280.494 — VAT: BE 1036.280.494 — E-mail: contact@alyvoa.com.
2. Products
The products offered are described and presented with the greatest possible accuracy. The images are provided for guidance only and may differ slightly from the actual product (colour, screen rendering). Products are offered subject to available stock.
3. Prices
Prices are shown in euros (€), all taxes included (Belgian VAT included). Any shipping costs are indicated before the order is confirmed. The applicable price is the one in force at the time of the order.
4. Order
The order is final once payment is confirmed. A confirmation e-mail summarising your order is sent to you. Alyvoa reserves the right to refuse or cancel any order in the event of a dispute, suspected fraud or failure to pay.
5. Payment
Payment is made online securely by bank card, PayPal, Apple Pay or any other method offered at the time of payment, via Shopify's secure solution. Your banking details are never kept by Alyvoa.
6. Shipping
Products are shipped with tracking to the address provided when ordering. Delivery times are given as a guide and are not guaranteed. The detailed terms are set out on our Shipping page. The transfer of risk takes place when the parcel is handed over to the customer.
7. Right of withdrawal
In accordance with Directive 2011/83/EU and the Belgian Code of Economic Law, you have a period of 14 days from receipt of your order to withdraw, without having to give any reason. The full terms and the standard withdrawal form are set out in our Refund and Withdrawal Policy. Returns are free and the refund is made no later than 14 days after notification of your decision.
8. Legal guarantee of conformity
All our products benefit from the 2-year legal guarantee of conformity provided for by Belgian law. In the event of a defect, contact us at contact@alyvoa.com.
9. Liability
Alyvoa cannot be held liable for damage resulting from misuse of the product, nor in the event of force majeure.
10. Personal data
The processing of your data is described in our Privacy Policy.
11. Disputes and mediation
These T&Cs are governed by Belgian law. In the event of a dispute, you may use the European Online Dispute Resolution platform free of charge: https://ec.europa.eu/consumers/odr, or the Consumer Mediation Service (Boulevard du Roi Albert II 8 boîte 1, 1000 Brussels — mediationconsommateur.be). Failing an amicable resolution, the competent courts are those of the jurisdiction of the seller's registered office, subject to the protective provisions applicable to the consumer.
